Welcome to OpenAgg (https://openagg.com). By accessing or using our service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use OpenAgg.

1. Description of Service

OpenAgg is a free AI photo tools gallery offering 20 AI-powered image processing tools. Users sign in with Google and receive 1,000 free tokens (credits) per day. Each tool consumes a certain number of tokens per use. AI results are generated by third-party models including Google Gemini, OpenAI GPT, and ByteDance Seedream.

2. Account and Access

To use OpenAgg, you must sign in with a valid Google account. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must be at least 13 years old to use the service. By creating an account, you represent that the information you provide is accurate and complete.

3. Acceptable Use

You agree not to use OpenAgg to:

• Upload, process, or generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Create deepfakes, non-consensual intimate imagery, or any content intended to deceive, defraud, or harm others.
• Infringe upon the intellectual property rights, privacy, or publicity rights of any third party.
• Attempt to reverse-engineer, exploit, or circumvent any security measures, rate limits, or credit systems.
• Use automated scripts, bots, or scrapers to access the service without prior written permission.
• Interfere with or disrupt the service, servers, or networks connected to OpenAgg.

4. AI-Generated Content Disclaimer

All results produced by OpenAgg tools are generated by third-party AI models. OpenAgg does not guarantee the accuracy, quality, completeness, or suitability of any AI-generated output. Results may contain errors, artifacts, or unintended content. You acknowledge that:

• AI-generated images may not accurately represent real people, places, or events.
• You are solely responsible for how you use, distribute, or publish AI-generated content.
• OpenAgg is not liable for any consequences arising from your use of AI-generated results.
• AI model behavior may change over time as providers update their systems.

5. Intellectual Property

5.1 Your Content

You retain ownership of the images you upload to OpenAgg. By uploading an image, you grant OpenAgg a limited, non-exclusive, temporary license to process the image solely for the purpose of generating AI results. This license terminates immediately upon completion of processing.

5.2 AI-Generated Output

To the extent permitted by applicable law, you own the AI-generated results created from your uploads. However, similar outputs may be generated for other users who provide similar inputs, and OpenAgg makes no guarantee of uniqueness.

5.3 OpenAgg Property

The OpenAgg name, logo, website design, and underlying technology (excluding third-party AI models) are the property of OpenAgg and its licensors. You may not copy, modify, or distribute any part of the service without prior written permission.

6. Credits and Usage Limits

Each user receives 1,000 free tokens per day, which reset at midnight UTC. Unused tokens do not carry over to the next day. OpenAgg reserves the right to modify credit allocations, introduce paid tiers, or change token costs per tool at any time with reasonable notice.

7. Data Handling

8. Third-Party Services

OpenAgg integrates with third-party AI model providers and other services. These third parties have their own terms and privacy policies. OpenAgg is not responsible for the practices, availability, or performance of any third-party service.

9. Limitation of Liability

To the maximum extent permitted by law, OpenAgg and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to:

• Loss of data, profits, or business opportunities.
• Errors, inaccuracies, or objectionable content in AI-generated results.
• Service interruptions, downtime, or unavailability.
• Unauthorized access to or alteration of your transmissions or data.

OpenAgg is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Indemnification

You agree to indemnify and hold harmless OpenAgg, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your infringement of any third-party rights.

11. Account Termination

OpenAgg reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, the service, or third parties. You may also delete your account at any time by contacting us. Upon termination, your right to use the service ceases immediately.

12. Changes to These Terms

We may revise these Terms at any time by updating this page. The “Last updated” date at the top indicates when the latest changes were made. Continued use of OpenAgg after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in San Francisco, California.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
